Liability Waiver

All participants in our charters, rentals, delivery or instructional services must accept and agree to the following liability waiver. All participants are encouraged to obtain appropriate insurance as to protect themselves in the event of an emergency or casualty.

Activity Description:

This waiver covers all activities associated with the rental, delivery, instructional use and operation of a vessel provided by Savage Charters LLC, including but not limited to boating, watersports (e.g., wakeboarding, water skiing, tubing, jet skiing, snorkeling, swimming), and other recreational or instructional activities on or in the water.

Acknowledgment of Risks:

I understand that participating in boating and watersports activities involves inherent risks, including but not limited to:

•  Physical injury, disability, or death due to collisions, falls, equipment failure, or water-related incidents (e.g., drowning, hypothermia).
• Property damage or loss.
• Risks from weather conditions, water currents, marine life, or other environmental factors.
• Risks from the actions or negligence of other participants, operators, or third parties.

I acknowledge that these activities require a reasonable level of physical fitness, and I confirm that I am in good health and have no medical conditions that would prevent safe participation. I agree to disclose any relevant medical conditions to Savage Charters LLC prior to participation.

Assumption of Risk:

I voluntarily assume all risks associated with participating in the activities offered by Savage Charters LLC, whether known or unknown, and accept full responsibility for any injuries, damages, or losses that may result for my entire party, including any minor children.

Release and Waiver of Liability:

In consideration of being permitted to participate in the activities, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and agree not to sue Savage Charters LLC, its owners, officers, employees, agents, or affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property, whether caused by the negligence of the Released Parties or otherwise, while participating in the activities.

Indemnification:

I agree to indemnify and hold harmless the Released Parties from any claims, costs, or liabilities, including attorneys’ fees, arising from my participation in the activities or any breach of this agreement.

Equipment Use:

I agree to use all equipment provided by Savage Charters LLC (e.g., boats, watersports gear, life jackets) in a safe and responsible manner. I acknowledge that I have been instructed on the proper use of the equipment and will inspect it before use. I accept responsibility for any damage to equipment caused by my misuse or negligence.

Compliance with Rules and Instructions:

I agree to follow all safety instructions, rules, and guidelines provided by Savage Charters LLC staff. I understand that failure to comply may result in my removal from the activity without a refund.

Alcohol and Drug Policy:

I certify that I am not under the influence of alcohol or drugs that would impair my ability to safely participate in the activities. I understand that Savage Charters LLC reserves the right to refuse service to anyone suspected of being impaired.

Photo/Video Release:

I grant Savage Charters LLC permission to use photographs or videos taken of me during the activities for promotional or commercial purposes without compensation.

Emergency Medical Treatment:

In the event of an emergency, I authorize Savage Charters LLC to secure medical treatment on my behalf. I agree to assume all costs associated with such treatment.

Governing Law:

This agreement shall be governed by the laws of the State of Maryland, USA. Any disputes arising from this agreement shall be resolved in the courts of  Anne Arundel County.

Severability:

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment:

I have read and fully understand this waiver and release. I am signing and accepting it voluntarily and with full knowledge of its legal consequences. I am at least 18 years of age, or if under 18, this waiver is signed by my parent or legal guardian.
